X’inhi l-proċedura ta’ applikazzjoni li għandha tiġi segwita?

  • In-notifika ta’ mewt li seħħet f’Malta tista’ ssir minn kwalunkwe persuna billi żżur l-uffiċċji tar-Reġistru Pubbliku fl-Isptar Mater Dei, l-Imsida jew f’Binja Onda, Triq Aldo Moro, il-Marsa f’każ ta’ mewt f’Malta u fir-Reġistru Pubbliku ta’ Għawdex, 132 Livell 2, Triq George Borg Olivier, Victoria, jekk il-mewt seħħet f’Għawdex. In-notifika tista’ ssir ukoll bil-posta billi tintbagħat email fuq publicregistry.identita@gov.mt għal Malta u localnotificationsgozo.pubreg@gov.mt għal Għawdex jew online billi wieħed iżur is-sit elettroniku ta’ Identità https://www.identita.gov.mt

  • Id-dokumentazzjoni meħtieġa hija d-“Dikjarazzjoni għan-Notifika tal-Mewt”. Din il-Formola tista’ tinkiseb ukoll f’kopja stampata mir-Reġistru Pubbliku ta’ Malta fil-Marsa, fl-Isptar Mater Dei, l-Imsida u fir-Reġistru Pubbliku ta’ Għawdex, Victoria. Aktar dokumentazzjoni meħtieġa biex titlesta notifika ta’ mewt tinkludi:

    • DH35 Ċertifikat tal-Mewt u l-kawża tiegħu maħruġ mit-tabib mediku li jiċċertifika l-mewt;

    • Il-karta tal-identità tal-persuna deċeduta;

    • Il-karta tal-identità ta’ min qed jinnotifika l-mewt.

  • Tista’ tkun meħtieġa dokumentazzjoni oħra, skont l-istat ċivili tad-deċedut. Ma hemm l-ebda ħlas għal notifika ta’ mewt.

  • F’każijiet fejn in-notifikant/i jiddeċiedi/u li jużaw l-uffiċċji tar-Reġistru Pubbliku, il-Marsa jew fl-Isptar Mater Dei, l-Imsida jew ir-Reġistru Pubbliku ta’ Għawdex, Victoria, l-uffiċjali tan-notifika tal-mewt jiggwidaw lin-notifikant tul il-proċess.

  • Dawk in-notifikanti li jiddeċiedu li jużaw is-servizz ta’ Notifika tal-Mewt tar-Reġistru Pubbliku online jew is-servizz postali jeħtieġ li jissottomettu l-Formola “Dikjarazzjoni għan-Notifika tal-Mewt” (li timtela` online jekk in-notifika ser issir online) u d-DH 35 “Ċertifikat ta’ Mewt u l-kawża tiegħu” maħruġ mit-tabib li jiċċertifika l-mewt, kif ukoll id-dokumenti ta’ identifikazzjoni tà min qed jagħmel in-notifika.

  • Hemm każijiet eċċezzjonali fejn il-proċess ta’ notifika tal-mewt ma jistax isir online. F-dan il-każ, in-notifikant għandu jżur ir-Reġistru Pubbliku fil-Marsa, l-Isptar Mater Dei, l-Imsida jew ir-Reġistru Pubbliku ta’ Għawdex, Victoria jekk il-mewt seħħet f’Għawdex.

  • In-notifikatur jiġi infurmat permezz ta’ SMS jew email kif l-Att tal-Mewt jiġi rreġistrat.

  • F’każ ta’ mewt ta’ ċittadin Malti barra mill-pajjiż, tista’ ssir ukoll reġistrazzjoni tal-mewt permezz ta’ waħda mill-Missjonijiet/Ambaxxati ta’ Malta. L-applikant għandu jissottometti lill-Missjoni l-att oriġinali tal-mewt taċ-ċittadin Malti maħruġ mill-awtorità barranija kompetenti.

  • Barra minn hekk, l-applikanti jistgħu jżuru wkoll ir-Reġistru Pubbliku fil-Marsa jew ir-Reġistru Pubbliku ta’ Għawdex f’Victoria biex jissottomettu personalment reġistrazzjoni tal-att barrani tal-mewt. Iċ-Ċertifikat tal-Mewt jista’ mbagħad jiġi ordnat mis-sit elettroniku tar-Reġistru Pubbliku www.certifikati.identita.gov.mt

Kif nista’ nipprova l-identità tiegħi?

  • Il-mezz aċċettat ta’ notifika huwa s-sottomissjoni ta’ dokumenti ta’ identifikazzjoni u l-firma tan-notifikant fuq id-dikjarazzjoni għan-notifika tal-mewt. Din il-firma tinġabar elettronikament meta n-notifikant imur personalment fir-Reġistru Pubbliku ta’ Malta f’Binja Onda, Triq Aldo Moro, il-Marsa, fl-Isptar Mater Dei, fl-Imsida jew fir-Reġistru Pubbliku ta’ Għawdex, 132 Livell 2, Triq George Borg Olivier, Victoria, Għawdex jew b’firma meta n-notifika ssir online jew bil-posta. Dokumenti oħra, skont l-istat ċivili tad-deċedut, jistgħu jkunu meħtieġa biex issir in-Notifika tal-Mewt.

  • F’każijiet ta’ mewt ta’ ċittadin Malti li jseħħ barra mill-pajjiż, ir-reġistrazzjoni tal-mewt tiġi sottomessa permezz ta’ waħda mill-Missjonijiet/Ambaxxati ta’ Malta, jew direttament lir-Reġistru Pubbliku ta’ Malta, Binja Onda, Triq Aldo Moro, il-Marsa, jew Reġistru Pubbliku ta’ Għawdex, 132 Livell 2, Triq George Borg Olivier, Victoria. Fiż-żewġ każijiet hija meħtieġa Ittra li tikkonferma ċ-Ċittadinanza Maltija maħruġa mill-Aġenzija Komunità Malta.

X’għandi bżonn nipprovdi?

  • In-notifikant li jissottometti notifika tal-mewt għandu jimla u jiffirma l-Formola “Dikjarazzjoni għan-Notifika tal-Mewt”, jissottometti ċ-“Ċertifikat ta’ Mewt DH35” maħruġ mit-tabib li jiċċertifika l-mewt, u d-dokumenti ta’ identifikazzjoni rilevanti tal-mejjet. F’każijiet fejn il-mewt ta’ ċittadin Malti sseħħ barra mill-pajjiż, huwa meħtieġ l-Att tal-Mewt oriġinali maħruġ mill-awtorità kompetenti.

X’nista’ nagħmel f’każ li jkun hemm tilwima?

  • Fejn għal xi raġuni, id-Direttur tar-Reġistru Pubbliku jirrifjuta li jirreġistra kwalunkwe Att, jew meta persuna tiddikjara li hemm xi żballf’parti partikolari tall-Att tal-Mewt wara r-reġistrazzjoni, jista’ jiġi ppreżentat rikors quddiem il-Qorti kompetenti f’termini tad-dispożizzjonijiet tal-Kodiċi Ċivili (Kapitlu 16 tal-Liġijiet ta’ Malta), li jitlob lil dik il-Qorti tordna r-reġistrazzjoni tal-Att jew il-korrezzjoni tal-partikolari inkwistjoni.

  • Ma jintalab l-ebda ħlas għal notifika ta’ mewt.

Kemm idum il-proċess u x’inhuma l-iskadenzi applikabbli?

  • Skont l-Artikolu 296 tal-Kodiċi Ċivili (Kapitolu 16 tal-Liġijiet ta’ Malta), l-avviż tal-mewt għandu jingħata mingħajr dewmien mit-tabib jew mill-kirurgu konxju tal-mewt ta’ kwalunkwe persuna f’Malta/Għawdex.

  • Barra minn hekk, l-Artikolu 297 tal-Kodiċi Ċivili (Kapitolu 16 tal-Liġijiet ta’ Malta) jistipula li fil-każ ta’ mewt ta’ kwalunkwe persuna li ma tkunx seħħet fil-preżenza ta’ tabib jew kirurgu, għandu jkun id-dmir tal-membri tal-familja, tal-impjegati domestiċi tal-mejjet jew tal-persuni li jokkupaw jew jamministraw id-dar/il-post fejn tkun seħħet il-mewt, li jagħtu avviż ta’ din il-mewt.

  • Skont l-Artikolu 305 tal-Kodiċi Ċivili (Kapitolu 16 tal-Liġijiet ta’ Malta), l-uffiċjal li jfassal att ta’ mewt għandu, fi żmien jumejn mit-tfassil tal-att, jagħti l-istess lid-Direttur tar-Reġistru Pubbliku għar-reġistrazzjoni.

X’nista’ nagħmel jekk il-mewt tibqa’ mhux irreġistrata?

  • F’każijiet fejn għal xi raġuni, id-Direttur jirrifjuta li jirreġistra kwalunkwe Att, l-utent jista’ jippreżenta applikazzjoni skont l-Artikolu 253 tal-Kodiċi Ċivili (Kapitolu 16 tal-Liġijiet ta’ Malta), fejn jitlob lill-Qorti kompetenti tirreġistra l-istess.

Il-proċess jista’ jitwettaq b’liema lingwi?

  • Il-proċedura tista’ ssir kemm bil-Malti u bl-Ingliż. L-oqsma kollha ta’ dokumentazzjoni, inklużi l-“Att tal-Mewt” u ċ-“Ċertifikat tal-Mewt” huma stampati kemm bil-Malti u bl-Ingliż.

X’għandi nagħmel jekk ma nisma’ xejn mir-Reġistru Pubbliku?

  • Ir-Reġistru Pubbliku jipprovdi informazzjoni dwar il-progress tan-notifika u r-reġistrazzjoni tal-Att u d-disponibbiltà taċ-“Ċertifikat tal-Mewt” tad-deċedut meta dan jintalab min-notifikant.

  • Barra minn hekk, mis-sit certifikati.gov.mt fejn iċ-Ċertifikati tal-Mewt jistgħu jiġu ordnati online, tintbagħat risposta bil-posta elettronika lill-persuna li għamlet l-ordni, f’każ li ċ-Ċertifikat tal-Mewt ikun għadu mhux disponibbli.

RULES ON REGISTRATION AND RECOGNITION OF DEATH

What is the application procedure to be followed?

  • The notification of a death that occurred in Malta can be made by any person by visiting the Public Registry offices in Mater Dei Hospital, Msida, or in Onda Building, Aldo Moro Road, Marsa in the case of a death in Malta and the Gozo Public Registry, 132 Level 2, George Borg Olivier Street, Victoria, if the death occurred in Gozo. The notification can also be made either by post by sending an email to publicregistry.identita@gov.mt for Malta and localnotificationsgozo.pubreg@gov.mt for Gozo, or online by visiting the Identità website https://www.identita.gov.mt.

  • The documentation required is the ‘Declaration for Notification of Death Form’. This Form can also be obtained in hardcopy from the offices of the Malta Public Registry in Marsa, at Mater Dei Hospital, Msida, and the Gozo Public Registry, Victoria. Further documentation required to complete a notification of death includes:

    • DH35 Certificate of Death and Cause Thereof issued by the medical doctor certifying the death;

    • The deceased person’s Identity Card;

    • The notifier’s Identity Card.

  • Other documentation, depending upon the civil status of the deceased may be required. No fee is levied for a death notification.

  • In cases where the notifier/s decide to use the Public Registry offices in Marsa or Mater Dei Hospital, Msida, or the Gozo Public Registry in Victoria, the death notification officers will guide the notifier through the process.

  • Those notifiers who decide to use the Public Registry Death Notification service online or the postal service need to submit the ‘Declaration for Notification of Death’ Form (filled in online in case of the former) and the ‘DH35 Certificate of Death and Cause Thereof’ issued by the doctor certifying the death as well as their identification documents.

  • There are exceptional cases where the death notification process cannot be done online. This requires the notifier to visit the Public Registry offices in Marsa, the Mater Dei Hospital, Msida, or the Gozo Public Registry, Victoria if the death took place in Gozo to complete the Death Notification.

  • The notifier is informed by an SMS or email once the Act of Death is registered.

  • In cases of a death of a Maltese citizen overseas, a death registration can also be made through one of Malta’s missions. The applicant must submit to the Mission an original act of death of the Maltese citizen in question, issued by the competent foreign authority.

  • Furthermore, applicants can also visit the Public Registry in Marsa or the Gozo Public Registry in Victoria to personally submit a registration of the foreign act of death. The Certificate of Death can then be ordered from the Public Registry website www.certifikati.identita.gov.mt

How do I prove my identity?

  • The accepted means of notification is the submission of appropriate identification documents and the signature of the notifying person on the Death Notice. This signature is collected electronically when the notifier notifies the death in person at the Malta Public Registry offices in Onda Building, Aldo Moro Road, Marsa, at Mater Dei Hospital, Msida, or the Gozo Public Registry, 132 Level 2, George Borg Olivier Street, Victoria, Gozo or by a wet signature when the notification is completed online or by post. Other documents, depending upon the civil status of the deceased may be required to complete the Notification of Death.

  • In cases of a death of a Maltese citizen occurring overseas, registration of death is submitted through one of Malta’s Missions, or directly to the Malta Public Registry offices in Onda Building, Marsa or the Gozo Public Registry, 132 Level 2, George Borg Olivier Street, Victoria, Gozo. In both cases, a Letter confirming Maltese Citizenship issued by Komunità Malta Agency is required.

What do I need to provide?

  • The notifier submitting a notification of death must fill in and sign the ‘Declaration for Notification of Death Form’, submit the ‘DH35 Certificate of Death and Cause Thereof’ issued by the doctor certifying the death, and the relevant identification documents of the deceased. In cases where the death of a Maltese citizen takes place overseas, an original Act of Death issued by a competent authority is required.

What can I do in case there is a dispute?

  • Where for some reason, the Director of the Public Registry refuses to register any Act, or where a person claims that there is an erroneous indication of any particular in the Act of Death following the registration thereof, an application may be filed before the competent court in terms of the provisions of the Civil Code (Chapter 16 of the Laws of Malta), requesting that court to either order the registration of the Act or to order the correction of the particular in question.

Are there any fees for this process?

  • No fee is charged for a death notification.

How long does the process take and what are the applicable deadlines?

  • According to Article 296 of the Civil Code (Chapter 16 of the Laws of Malta), the notice of death shall be given without delay by the physician or surgeon aware of the death of any person in Malta/Gozo.

  • Furthermore, Article 297 of the Civil Code (Chapter 16 of the Laws of Malta) stipulates that in the case of the death of any person who has not been attended by a physician or surgeon, it shall be the duty of the members of the family, domestic servants of the deceased or persons occupying or managing the house/place in which the death occurred, to give notice of such death.

  • In terms of Article 305 of the Civil Code (Chapter 16 of the Laws of Malta), the officer drawing up an act of death shall, within two days from the drawing up of the act, deliver the same to the Director of Public Registry for registration.

What can I do if the death remains unregistered?

  • In cases where for some reason, the Director refuses to register any Act, the user may apply terms of Article 253 of the Civil Code (Chapter 16 of the Laws of Malta), requesting the competent court to register the same.

The process can be performed in which languages?

  • The procedure can be carried out in Maltese and English. All documentation fields, including the ‘Act of Death’ and ‘Death Certificate’ are printed in Maltese and English.

What should I do if I have not heard from the Public Registry?

  • The Public Registry supplies information regarding the progress of notification and registration of the Act and availability of the ‘Death Certificate’ of the deceased when this is requested by the notifier.

  • Furthermore, the certifikati.gov.mt website where Death Certificates can be ordered from, provides feedback via email to the person/s ordering in case the Death Certificate is not yet available.
